Terms of Service

These terms govern your use of the BYOB.asia website (the "site") and any services we provide. By using the site or engaging us, you agree to these terms. If you do not agree, please do not use the site or engage our services.
1. Who we are
"BYOB.asia", "we", "us", and "our" refer to BYOB.asia, a digital services business based in Kuala Lumpur, Malaysia. "You" refers to any individual or organisation using the site or engaging our services.
2. Use of the site
The site is provided for informational purposes. You may browse it, share links to it, and contact us through it. You may not (a) attempt to compromise the site's security, (b) use automated tools to scrape large volumes of content, or (c) misrepresent yourself when contacting us.
3. Our services
Service descriptions, packages, and prices on this site are intended as accurate guidance. The binding terms for any specific engagement are set out in the project proposal and signed contract — not on this site.
4. Fixed-price guarantee
Where we offer a fixed price for a project, that price is set in the signed proposal and will not increase unless you request scope changes that are mutually agreed in writing before any additional work begins.
5. 14-day refund guarantee
Our refund guarantee applies to projects with a delivery date set in the signed proposal. If we fail to deliver the agreed scope by the agreed date due to causes within our control, you are entitled to a full guarantee of fees paid. The guarantee does not apply where:
- Delivery is delayed because client feedback, content, or approvals are outstanding for more than 5 business days.
- You request scope additions after the project has started.
- The delay is caused by force majeure (defined below).
Refund requests must be made in writing within 14 days of the missed delivery date. Refunds are processed within 14 business days of approval.
6. Payment terms
Standard terms are 50% on project commencement and 50% on delivery, unless otherwise agreed in the signed proposal. Invoices are issued in SGD, MYR, or THB depending on the client's location. Late payments may incur interest at 1.5% per month.
7. Ownership of deliverables
Upon full payment, you own all final deliverables: source code, design files, brand assets, and documentation. We retain the right to display non-confidential project work in our portfolio and case studies, with your prior written consent.
8. Third-party services
Where projects use third-party services (e.g. hosting, payment gateways, plugins, fonts), you agree to their respective terms of service and pay any fees directly to them. We are not responsible for third-party service availability or pricing changes.
9. Confidentiality
We will not disclose any confidential information you share with us during a project to any third party, except as required by law or with your explicit written consent.
10. Limitation of liability
Our total liability for any claim arising from a project is limited to the total fees paid by you for that project. We are not liable for any indirect, consequential, or incidental damages, including lost profits or business opportunities.
11. Force majeure
Neither party is liable for delay or failure caused by events beyond reasonable control, including natural disasters, war, government action, internet outages, or pandemics.
12. Termination
Either party may terminate an engagement with 14 days' written notice. If you terminate before completion, you are responsible for paying for work delivered up to that point. We reserve the right to refuse or end an engagement where the project requires us to act unethically or unlawfully.
13. Governing law and disputes
These terms and any project agreements are governed by the laws of Malaysia. Disputes will first be addressed through good-faith negotiation. If unresolved, they will be submitted to mediation in Kuala Lumpur before any court action.
14. Changes to these terms
We may revise these terms from time to time. Material changes apply only to engagements signed after the change is published. The "last updated" date above reflects the latest revision.
